General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all services provided by Chatel Claire Immobilien AG, Bollwerk 21, 3011 Bern, Switzerland (hereinafter referred to as “Chatel Claire”).

The services consist in particular of the rental of exclusive apartments and chalets in the Bernese Oberland and in Bern.

The guest or booking party is hereinafter referred to as the Contracting Party.

By booking an accommodation, the Contracting Party accepts these GTC.

2. Booking and Conclusion of Contract

A booking may be made by telephone, e-mail, via our website, or through external booking platforms.

The rental agreement is concluded as soon as the booking has been confirmed by Chatel Claire.

The booking confirmation includes in particular:

  • Rental property
  • Duration of stay
  • Number of guests
  • Rental price
  • Payment terms
  • Cancellation policy

These details are binding.

Chatel Claire reserves the right to confirm bookings only after full or partial advance payment.

3. Arrival and Departure

The accommodation is available from 3:00 p.m. on the day of arrival.

On the day of departure, the accommodation must be vacated by 12:00 noon at the latest.

Earlier check-ins or later check-outs are only possible by prior arrangement and may be subject to an additional fee.

If the accommodation is occupied late or vacated early, there is no entitlement to a refund.

4. Occupancy and Use

The accommodation may only be occupied by the number of persons stated in the booking confirmation.

Guests undertake to treat the rental property and its furnishings carefully and respectfully and to show consideration for neighbors and the surrounding area.

Guests are responsible for cleaning dishes and kitchen utensils as well as disposing of waste during their stay.

5. Pets

Pets are only allowed with the prior consent of Chatel Claire and may be subject to an additional fee.

The Contracting Party is liable for any damage caused by a pet.

6. Prices

The stated prices are rental prices for the entire property per stay or per night.

Additional costs may arise for:

  • Final cleaning
  • Bed linen
  • Visitor’s tax / tourist tax
  • Additional services

The prices stated in the booking confirmation shall always prevail.

7. Payment Terms

Unless otherwise agreed, the following payment terms apply:

  • For non-refundable bookings, the full amount is due at the time of booking.
  • For refundable bookings, the full amount is due at the time of booking.

All payments must be made without deductions.

8. Cancellation Policy

In the event of cancellation, the following conditions apply:

  • 30 days before arrival: free of charge
  • From 28 days before arrival: 100% of the rental price

For non-refundable bookings, the full amount remains due regardless of the cancellation date.

The relevant date is the date the cancellation is received.

9. Security Deposit

For certain accommodations, a security deposit of CHF 300 – CHF 500 may be required.

This serves to cover possible damages or extraordinary cleaning costs.

10. Liability of the Contracting Party

The Contracting Party is liable for all damages caused by themselves or by accompanying persons.

Damages must be reported immediately.

In the event of lost keys or damaged furnishings/equipment, the corresponding costs may be charged.

11. Liability of Chatel Claire

Chatel Claire undertakes to provide the Contracting Party with a rental property in accordance with the contract.

Should an accommodation become unavailable for unforeseen reasons, Chatel Claire may offer equivalent alternative accommodation.

Liability is limited to the rental price to the extent permitted by law.

Chatel Claire is not liable for:

  • Force majeure
  • Infrastructure failures
  • Burglary or loss of personal belongings
  • Loss of holiday enjoyment or consequential damages

12. Data Protection

Personal data is processed exclusively for handling the booking, communication with guests, and fulfilling legal obligations.

13. Applicable Law and Jurisdiction

Swiss law shall apply.

The place of jurisdiction is Bern, Switzerland, to the extent permitted by law.
